Acquisition of Land Act 1967
TAKING OF EASEMENT NOTICE BY THE MINISTER
(NO 15) 2014
Short title
1. This notice may be cited as the Taking of Easement Notice by the
Minister (No 15) 2014
Easement taken [ss.6 and 9(7) of the Act]
2. The easement described in Schedule 2 is taken by Mackay Regional
Council for drainage purposes and vests in Mackay Regional Council
on and from 19 December 2014.
Rights and obligations
3. That the rights and obligations conferred and imposed by the
easement include the matters set out in Schedule 1.
SCHEDULE 1
1.
Grant of Easement
The Owner hereby grants to the Mackay Regional Council (the
“Council”) the full and free right and liberty of using the Easement
Area for drainage purposes and to exercise all powers, authorities
and discretions vested in it by law for the passage or conveyance
of storm water.
2.
Council’s Rights
The Council has the right at all reasonable times, with or without
vehicles, machinery, plant and equipment and materials, to enter
upon the Easement Area to pass and repass along the same at all
times for the purposes of using and repairing the Works and in so
doing the Council’s Employees may:
(1) remove and replace the Works with new Works;
(2) change the size and number of any pipes forming part of the
Works;
(3) extend, deepen, widen, repair, renew, mow, cleanse, add to,
inspect and maintain the Works including altering, replacing,
relaying or changing the size, shape or type;
(4) dig into, sink shafts into and open and break up the soil of the
Easement Area;
(5) remove and dispose of soil created as a consequence of the
Council exercising its rights under this Easement;
(6) do such other Works and things on or under the Easement
Area as are incidental to the exercise of the Council’s rights
under this Easement;
(7) take down any fencing or structure erected on the Easement
Area.
3.
Owner’s Obligations
The Owner must not without prior written consent of the Council:
(1) construct or allow to be constructed upon the Easement Area
any buildings or structures;
(2) permit the Easement Area to be used in such a way as to
obstruct or interfere with the Works and/or the proper and
effective use of the Works by the Council;
(3)
install or have installed any concrete or bitumen paths or
driveways on the Easement Area or gardens or landscaping
using brick, concrete or other permanent materials;
(4) alter the surface level of the Easement Area;
(5) obstruct, interrupt, impede, impair, or interfere with or divert
WKHÀRZRIVWRUPZDWHUGUDLQDJHDORQJWKH(DVHPHQW$UHD
and will not change or alter anything done by the Council in
terms hereof.
4.
Property in Works
4.1 The Works remain the property of the Council despite being
¿[HGWRWKH(DVHPHQW$UHD
4.2 The Council is solely responsible for the maintenance of the
Works.
5.
General
Notices
(1) Any notice under this Easement must be in writing; and
(2) Either party may serve a notice to the other party by:
(a) giving it to that party personally;
(b) posting it to the last known address of that party;
(c) sending it to the party’s facsimile number.
(3) When served by post a Notice will be deemed to have been
received on the second business day after posting and when
sent by facsimile will be deemed to have been received at the
WLPHDWZKLFKWUDQVPLVVLRQFRQ¿UPDWLRQLVUHFHLYHGE\WKH
Sender.
6.
Construction and interpretation
'H¿QLWLRQV
(1) “Council” means the Council and its successors and assigns;
(2) “Council’s Employees” means each of the Council’s
employees, contractors or other persons authorised by the
Council;
(3) “Owner” means the Owner and includes;
(a) the executors, administrators and assigns of the Owner
and each of them;
(b) the registered owner for the time being of the Easement
Area and the land of which it forms part from time to
time.
(4) “Easement Area” includes any part of the Easement Area;
(5) “Work” means:
(a) open earth drains, pipes or mains for the purpose of
conveying storm water under or over the Easement
$UHDWRJHWKHUZLWKDOORWKHUXVXDODQGQHFHVVDU\¿WWLQJV
and attachments; and
(b) works for the protection and/or support of each of those
things.
6.2 Construction
Reference to:
(1) a person includes:

(b)
a corporation and governmental body; and
the legal representative, successors and assigns of that
person;
(2) a right includes a remedy, authority or power;
(3) a gender includes all genders;
(4) the singular includes the plural and the plural includes the
singular;
(5) any Act includes all amendments or substitutions for that Act
and the Regulations made under that Act.

1. This notice may be cited as the Objections to Proposed Road
Closure Notice (No 49) 2014.

Objections
3.(1) An objection (in writing) to a proposed road closure

OF STATE-CONTROLLED ROADS
Notice is hereby given under sections 24 and 25 of the Transport Infrastructure Act 1994, that the roads or routes, or parts of the roads or routes
described in the schedule are hereby declared or revoked as State-controlled roads, as the case may be. As required by the abovementioned sections of
the Transport Infrastructure Act 1994, the relevant local governments have been notified and the declarations described in the schedule below are
consistent with the department’s transport infrastructure strategies.

Notice is given under the Sustainable Planning Act 2009 that on
17 December 2014 Cairns Regional Council resolved to adopt an
administrative amendment to CairnsPlan 2009 (2014 No. 1
Flood Management Code and Flood Management Overlay). The
amendment will have effect on and from 19 December 2014.
The purpose and general effect of the administrative amendment
is to correct a factual matter incorrectly stated in the planning
scheme.

Short title
1. This notice may be cited as the Declaration of Luxury Motor
Vehicles (No. 01) 2014 .
Commencement
2. This notice shall commence on 19 December 2014.
Definitions
3. In this notice:
"luxury motor vehicle" means a vehicle declared by the chief
executive under Section 145 of the Transport Operations
(Passenger Transport) Act 1994 (the Act) to be a luxury motor
vehicle.
Declaration of particular motor vehicles [s.145 of the Act]
4. The chief executive may, by gazette notice, declare a vehicle
to be a luxury motor vehicle. This authority is delegated to
the Executive Director, PT Standards and Contracts.
5.
By that authority the following vehicles are approved as
luxury motor vehicles for a period of six months from the
date of this notice:
– Chrysler 300C sedan with a date of compliance shown
on the identification plate placed on the vehicle under
the Motor Vehicle Standards Act 1989 (Cwlth) being
2013, 2014 or 2015.
– Holden Caprice sedan with a date of compliance shown
on the identification plate placed on the vehicle under
the Motor Vehicle Standards Act 1989 (Cwlth) being
